This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.
This notice applies to dental care provided by Amid Dentistry LLC, DBA All On Smiles, presented on this website as All On Smiles Cosmetic Dentistry, at 700 S Henderson Rd Ste 306, King of Prussia, PA 19406. It describes the practice’s duties and your rights concerning protected health information, including dental records, images, treatment information, and related payment records.
Privacy questions or requests: Call (484) 283-5388 and ask for the person responsible for privacy matters. You may also write to the practice at the address above or use our contact form to ask how to communicate securely. Please keep sensitive health information out of your contact form message.
Your privacy rights
See or receive a copy of your records
You may request to inspect or receive a paper or electronic copy of the health information we maintain about you in a designated record set. Contact the office to begin a request. We generally act within 30 days. If a permitted extension is necessary, we will explain the reason and completion date in writing. A reasonable, cost-based copying fee may apply as allowed by law. If access is denied, we will provide a written explanation and any available review rights.
Ask for a correction
You may ask us in writing to amend information you believe is inaccurate or incomplete and explain why. We may deny a request in circumstances allowed by law, but will explain a denial in writing, generally within 60 days, including how to submit a statement of disagreement. We will notify you if a permitted extension is needed.
Choose how we contact you
You may request a reasonable alternative way or location for confidential communications, such as a different telephone number or mailing address. We will accommodate reasonable requests. Tell the office your preference.
Request a restriction
You may ask us to limit information used or shared for treatment, payment, or health care operations, or with people involved in your care. We generally do not have to agree, but will follow an agreed restriction subject to legal exceptions, such as emergency treatment.
If you pay in full out of pocket for a health care item or service, you may ask us not to disclose information about that item or service to your health plan for payment or health care operations. We must honor that request unless disclosure is required by law. Tell us before the information is sent to the plan.
Request an accounting of disclosures
You may request a list of certain disclosures made during the six years before your request. The list generally excludes disclosures for treatment, payment, and health care operations, disclosures made with your authorization, and other exceptions allowed by law. One accounting in a 12-month period is free. We will tell you about a permitted fee for additional requests before proceeding.
Receive this notice and use a representative
You can request a paper copy of this notice at any time, even if you agreed to receive it electronically. A person legally authorized to act for you may exercise your rights after we verify that person’s authority, subject to applicable limits and protections.
How information may be used and shared
Subject to applicable legal requirements and the additional protections below, we may use or disclose health information without a separate authorization for the following purposes.
Treatment
We use information to evaluate your oral health, plan treatment, and coordinate care. For example, a dentist may share relevant images or treatment information with a specialist involved in your care. We may contact you about an appointment, treatment alternatives, or health-related services relevant to your care.
Payment
We use information to bill for care, verify coverage, and obtain payment. For example, an insurance claim may include the treatment provided and information needed for the plan to process it, subject to any restriction we are required to honor.
Health care operations
We use information to manage the practice, assess and improve care, train staff, and perform administrative activities. Vendors acting as business associates may receive information needed to provide authorized services, with the agreements and safeguards required by law.
People involved in your care
We may share information relevant to a family member’s, friend’s, or another person’s involvement in your care or payment when you agree, have an opportunity to object and do not, or when another legal basis permits it. Tell us your preferences. If you cannot express a preference, we may use professional judgment to share information in your best interests. Similar rules may permit limited sharing for disaster relief.
Other uses permitted or required by law
We may share information for the following purposes only when the legal conditions for that disclosure are met:
- Public health and safety: reporting disease, product problems, or suspected abuse or neglect; responding to permitted public health activities; or helping prevent a serious and imminent threat.
- Health oversight: authorized audits, licensing, inspections, investigations, and other oversight activities.
- Research: health research that meets applicable authorization, review, or other legal requirements.
- Legal proceedings and law enforcement: a court or administrative order, or a subpoena or other request that meets the required safeguards. A request alone does not override applicable privacy protections.
- Special situations: workers’ compensation, organ or tissue donation, coroners, medical examiners, funeral directors, and authorized military, national security, correctional, or other government functions.
- Required disclosures: disclosures required by law, including to the U.S. Department of Health and Human Services to review compliance with privacy requirements.
Uses requiring written authorization
We will obtain your written authorization for uses or disclosures not otherwise permitted or required by law. This includes marketing uses that require authorization and most uses or disclosures of psychotherapy notes, if we hold them. We do not sell your personal information; a sale of protected health information would require a specific authorization under HIPAA.
You may revoke an authorization in writing, except to the extent we have already acted in reliance on it or another legal exception applies. Revocation does not undo a disclosure already made lawfully.
If we send a fundraising communication, you may opt out of further fundraising contacts. For fundraising that would use records protected by 42 CFR Part 2, you must first receive a clear opportunity to choose whether to receive those communications.
Records with additional protections
Substance use disorder records
If we receive or maintain substance use disorder patient records protected by 42 CFR Part 2, additional restrictions apply. Those records, or testimony describing their contents, cannot be used or disclosed in a civil, criminal, administrative, or legislative investigation or proceeding against you without your specific written consent or a qualifying court order and subpoena or similar legal mandate. A consent for proceedings against you must be separate from a consent for other purposes.
Where Part 2 permits records received under a consent for treatment, payment, and health care operations to be shared under HIPAA, the restrictions on use in proceedings against you still apply. Other applicable consent and disclosure limits must also be followed.
Pennsylvania and other privacy protections
When another applicable law provides stronger protection, we follow that protection. Pennsylvania law places additional limits on disclosure and redisclosure of confidential HIV-related information. When it applies, a specific written consent or a statutory exception is required; a general release of medical information is not enough.
Mental health treatment records and other specially protected records may also have additional consent or disclosure restrictions. We apply the rules that govern the particular record before releasing it. These protections can limit a disclosure that HIPAA would otherwise allow.
Information received by another person
Information lawfully disclosed to a recipient may be disclosed again by that recipient and may no longer be protected by HIPAA if the recipient is not subject to it. Applicable Part 2, Pennsylvania, or other confidentiality restrictions may continue to protect particular records.
Our responsibilities
We are required to protect the privacy and security of protected health information, provide this notice, and follow the duties and practices described in it. We must notify affected individuals following a breach of unsecured protected health information as required by law. We will not use or share information beyond what this notice and applicable law allow without the required authorization.
We may change this notice and make a revised version apply to information already held as well as information received later, as permitted by law. The current notice will be available in the office, on this website, and on request, with its effective date.
You may be asked to acknowledge receipt of the notice. An acknowledgment confirms receipt; it is not an authorization to use or disclose information beyond what the law permits.
